Uncontested Divorce

An uncontested divorce means that the spouses have agreed to divorce and have reached an agreement about all major issues involved in ending their marriage.

Uncontested Divorce

Divorce is a relatively easy process if both parties are willing to work together for a common end goal. An uncontested divorce requires less paperwork than a contested divorce and is also less expensive by far. In California, in most cases, at least one of the parties must be a resident of California for at least 6 months prior to filing a petition for divorce, and a resident of the county in which the petition will be filed for at least 3 months prior to filing the petition.

All divorces, including an uncontested one, require filing a number of forms with the court. A registered and bonded Legal Document Assistant is an affordable alternative to expensive lawyer fees; however, if a dispute arises between the parties, then it is usually best to hire an attorney to make sure that all legal requirements are met.
